If necessary, Anyone AI may complement this Privacy Policy with information and definitions from the Terms and Conditions specific to the Service, as defined in each of the Terms and Conditions, hereinafter defined.

Our Privacy Policy applies to all visitors, users, and others who access the Website, Learning Platform, or Service (“Users”). By accesing the Website, or using the Learning Platform, or the Service, the User express the acceptance, without reservation, of any terms of the Privacy Policy published by Anyone AI. The Privacy Policy shall constitute a valid and binding agreement between theUser and Anyone AI concerning its privacy (hereinafter, the "Terms and Conditions").

1. RESPONSIBLE FOR THE PROCESSING OF YOUR PERSONAL DATA

Anyone AI will be the controller of any Personal Data that the User provides on the Website or the Learning Platform, or thePersonal Data collected or processed on the Learning Platform, for or through, or in connection with the Services. Any collections,use, and sharing of information to the User's Personal Data shall be governed by this Privacy Policy. Anyone AI considers that theprivacy of the User's personal data is extremely important to Anyone AI. In case the User has any questions about this PrivacyPolicy, or about the application thereof, the User should contact Anyone AI, at any time, by sending an e-mail to academy@anyoneai.com.

2. USER INFORMATION RECOLLECTION. PERSONAL DATA PROCESSING PURPOSES.

2.1. Anyone AI only processes the Personal Data, due to the express consent that the User grants by accepting this Privacy Policy through the corresponding check box or button on the Website or the Learning Platform.

2.2. Anyone AI may request from the User and store the following personal data (collectively, the " Personal Data"):

(i) Information provided by the User: (i) name and surname; (ii) e-mail; (iii) residence; (iv) age; (v) studies and career; (vi)curriculum; (vii) photo.

(ii) Passively Collected Information: When the User accesses the Website or the Learning Platform and/or uses the Service,Anyone AI may automatically collect and store certain types of information, such as the Internet protocol (IP) address of the User's computer or device and other technical information about the use of the computer or device, such as browser type and version, timezone settings, and operating system, geographic locations, usage sessions, time spent on the Website or the Learning Platform, frequency of use. The User agrees that Anyone AI may collect information from the User using cookies and tags, as well as information provided by the User through the forms on the Website or the Learning Platform when applying or registering and/or using the Services described in the Terms and Conditions.

(iii) Information from other sources: Anyone AI may receive information about the User from other sources such as public sources, or third parties. Anyone AI may require, at its discretion, the information to verify the credit profile of the User to understand if the User can commit or not to the Compensation following the Terms and Conditions.

2.3. Anyone AI may collect information about the User's location when using the Services to provide certain features or to personalize the Service. To determine the location of Users with different levels of accuracy, Anyone AI may use the following information: Localization and IP Address. The location information that Anyone AI collects depends partially on the configuration of the User's device and Account. For example, the User can turn its location on or off through its device settings, and/or location history.

2.4. Also, Anyone AI may collect personal information from the User at the time that the User agrees to use the video camera to be able to attend the trainings on the Learning Platform.

2.5. In addition, Anyone AI may use the User's Personal Data for the provision of a method of communication between the Users for the purposes required by the Users.

2.6. The objective of the processing of the User’s Personal Data are:

(i) To authorize and manage the User’s access to the Website and the Learning Platform, verify your identity, authenticate your visits and provide the User with the Service;

(ii) To improve the quality of the Service or the admission process provided through the Website or the Learning Platform. The storage by Anyone AI of the IP number of the User's devices is used to identify the User at the time of logging into their accounts when they have been contracted to Anyone AI. It also facilitates the diagnosis of possible connection problems that may exist in theLearning Platform, improving the quality of the Service. The IP (Internet Protocol) number or address is a numerical identification that distinguishes an electronic computing device (whether it is a computer, a personal phone with network access, a tablet, a PDA, etc.) that connects to a computer network (e.g., the Internet);

(iii) Manage, analyze, develop, customize and improve the Website, the Learning Platform, and the Service;
(iv) To offer the User a personalized Service, customized to the User's needs to provide the best possible experience;
(v) To connect Users, allowing them to contact each other to work together when assisting Anyone AI's trainings;
(vi) Manage any type of inqury that Users may have;
(vii) Anyone AI may send to its Users, notifications, news, and information of their interest, in addition to those of an institutional or legal nature;
(viii) Analyze the behavior of Users as such on its Website and Learning Platform, to try to improve its Service and try to provide them with better solutions to their needs;
(ix) Sending updates and newsletters about Anyone AI's news, its Services, and events via WhatsApp, telephone, postal mail, email, even when the training has ended unless the User indicates the contrary;
(x) Compliance with legal obligations in case of being requested by courts, or national or international state agencies that so require and request it in the corresponding form;
(xi) To grant a communication channel with other Users or with the professors and coordinators so that the User can solve his queries and doubts related to the training;(xii) To execute certain metrics for internal use and to share with Partners.

3. THE USE OF USER DATA COLLECTED.

3.1. Anyone AI shall store and use the information provided by the User and collected by Anyone AI for the maximum term established by applicable law to analyze it and to provide the Users with the best Service possible.

3.2. Any person who has provided personal contact information through the Website or Learning Platform, may send an email toacademy@anyoneai.com to update, delete and/or correct his personal contact information. Anyone AI shall respond to such request within 48 (forty-eight) hours of receipt of such request via email.

3.3. Only to fulfill the purposes outlined in this Privacy Policy and to provide the Service, Anyone AI may disclose the User'sPersonal Data and/or personal information, when necessary, to authorities, Anyone AI's partners, and other third parties, such as third-party service providers used in connection with the Service, for example, to perform marketing, advertising, communication, infrastructure, and IT services, to customize and improve our Service, to process credit card transactions or other payment methods.When Anyone AI contracts with a third-party service provider, it will provide them with the information they need to perform their specific functions, which may include Personal Data and other information that the User provides through the Platform. These service providers are authorized to use Personal Data only when it is necessary to provide their services.

3.4. Anyone AI may share the information with Partners for the above purposes described in the Terms and Conditions and with other companies or websites or similar services for the same purposes as described above. Generally, such companies or websites have their data privacy policies for data protection. However, Anyone AI shall do its best to ensure that the privacy of the information shared is protected under the laws in force at any time. When applicable, Anyone AI shall try to sign express agreements on data protection and privacy of information. Notwithstanding the above, Anyone AI shall not be liable for damages caused by such companies and/or Internet sites regarding their duty of protection, confidentiality, and privacy of the data they process.

3.5. The Website or the Learning Platform may contain links to other Internet sites that are not the property of Anyone AI. Consequently, Anyone AI shall not be responsible for the actions of such websites, to which this Privacy Policy does not apply. 3.6. Anyone AI will keep the Personal Data provided, only for the time necessary to fulfill the purposes described in the previous section.

Once the relationship between the Parties is concluded, for any reason, Anyone AI reserves the right to keep the mentioned information for a term of 5 (five) years from the end of the Applicable Training or from the time the User has interacted in theAnyone AI Community, whatever is longer. After the mentioned term, Anyone AI will destroy Personal Data.

3.8. Anyone AI shall use the information provided by the Users and the one collected by Anyone AI in case of being requested by courts, or national or international state organizations that require it and request it through a corresponding form.

4. DATA TRANSFER.

4.1. Only for the purposes set forth in this Privacy Policy and to provide the Service, Anyone AI may disclose Personal Data and/or personal information, when necessary, to authorities, Anyone AI's partners, and other third parties, such as third-party service providers used to provide services.

4.2. In some cases, Personal Information may be transferred out of the country to countries with the same or better levels of protection. If personal information is transferred to countries with lower levels of protection, Anyone AI will make such transfers bound by appropriate safeguards and security measures, such as standard data protection clauses adopted in the respective agreements or approved by the applicable legal authority.

5. CONFIDENTIALITY AND SECURITY OF THE INFORMATION.

5.1. Anyone AI has adopted reasonable security measures to protect the User's information and to prevent unauthorized access to theUser's data or any unauthorized modification, disclosure, or destruction of such data. The information collected by Anyone AI or provided by the User will be maintained in a strictly confidential way. The access to Personal Data is restricted to those Anyone AI employees, contractors, operators, customers, and representatives of Anyone AI who need to know such data to perform their duties and to develop or improve the Service. Anyone AI requires the same standards of confidentiality from its suppliers. Anyone AI does not allow access to this information to third parties outside Anyone AI, except at the express request of the User.

5.2. Notwithstanding the above, considering that the Internet is an open system, with public access, Anyone AI cannot guarantee that unauthorized third parties cannot eventually overcome the security measures and use the User's information improperly. In any case, Anyone AI maintains security and incident response plans to control incidents related to unauthorized access to private information we collect or store.

6. MODIFICATIONS OF THE CORPORATE STRUCTURE.

6.1. Anyone AI may transfer the information collected in case of a sale or a merger of Anyone AI, or acquisition of Anyone AI's principal assets or any other kind of transfer from Anyone AI to another entity and/or between Anyone AI entities. In such an event,Anyone AI shall take reasonable steps to ensure that such information is used consistently with the Privacy Policy.

7. THE USER'S RIGHTS REGARDING THE INFORMATION.

7.1. Anyone AI will try, by all the possible ways at its disposal, to provide the User over it has collected or stored personal information, the access to its Personal Data ("Right of Access"), as well as the rectification, modification or update thereof ("Right of Rectification"), or even the deletion of such personal data ("Right of Removal"), unless Anyone AI may deny such requests (hereinafter, the "Requests"), in case it is forced or entitled to keep such Personal Data following the applicable law.

7.2. To such effects, the User shall send its Request by e-mail with the subject "Access to Personal Data" to academy@anyoneai.com. Anyone AI may require such User to identify itself, which can be verified by Anyone AI, as well as to specify the Personal Data to be accessed, rectified or removed.

7.3. Anyone AI may refuse to process any Requests that are unreasonably repetitive or systematic, require a disproportionate technical effort, compromise the User's privacy, are considered impractical, or where access to the Data is not necessary.

7.4. The service of access, rectification, and deletion of Personal Data will be provided by Anyone AI free of charge, except in case it would require a disproportionate or unreasonable effort, in which case an administration fee may be charged.

7.5. If the User considers that its rights are violated under the personal data protection laws in force, the User will have the right to exercise the right of access, portability, rectification, or removal thereof free of charge to the applicable authority according to the country where the User is located.

8. EXCEPTIONS.

8.1. Notwithstanding any other provision in the Privacy Policy to the contrary, Anyone AI may disclose certain personal information of the User, when Anyone AI believes in good faith that such disclosure is reasonably necessary to:

(i) Prevent a legal responsibility;

(ii) Comply with a legal requirement, such as a search warrant, court order, or subpoena;

(iii) Comply with a governmental or other regulatory requirements; and/or

(iv) Protect the rights, property, or safety of Anyone AI, the User, or a third party.

9. CHANGES IN THIS PRIVACY POLICY.

9.1. Anyone AI may modify this Privacy Policy at any time. The new versions of the Privacy Policy will be notified by posting such a new version on the Website or in the Learning Platform and notified by the channels of communication that the User declares in its case.
